  1. The Programme<\/strong>
    \nThe YES Kasi Up Refer & Earn Programme (\u201cR&E Programme<\/strong>\u201d) is organized by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) ( \u201cYTLC\u201d<\/strong>). Eligible Person participating in this R&E Programme shall be subjected to these YES Kasi Up Refer & Earn Programme Terms and Conditions (\u201cR&E Programme T&Cs<\/strong>\u201d).<\/li>\n
  2. Eligibility.<\/strong>
    \nThis R&E Programme is open to all Yes Subscribers of the Postpaid Service Plans and Prepaid Service Plans(including the YES Prihatin Prepaid Service Plan) who are 18 years and above provided always that his\/her Service Account is not barred or suspended (\u201cEligible Persons<\/strong>\u201d or each, an \u201c Eligible Person<\/strong>\u201d).<\/li>\n
  3. Applicable Terms & Conditions.<\/strong>
    \n3.1 Subject only to the variations as expressly set out in these R&E Programme T&Cs, all other terms and conditions incorporated in the Postpaid Service Terms and Conditions, Postpaid Service Plans Terms & Conditions, Prepaid Service Terms and Conditions, Jaringan Prihatin Programme Terms and Conditions and Yes 4G LTE Prepaid Plan Terms and Conditions available at www.yes.my\/tnc<\/a> shall remain valid and applicable to this R&E Programme (collectively referred as \u201cGeneral Applicable Terms and Conditions\u201d). In the event of any inconsistency between the General Applicable Terms and Conditions and these R&E Programme T&Cs, these R&E Programme T&Cs shall prevail to the extent of any such inconsistency.
    \n3.2 All capitalised words not defined herein shall have the same meaning ascribed to in the General Applicable Terms and Conditions:
    \n\u201cCash Reward<\/strong>\u201d means reward in the form of cash earned by the Referrer and\/or Referee, respectively, as more specifically set out in Clause 6, subject to these R&E Programme T&Cs.
    \n\u201cExcluded Service Plans<\/strong>\u201d means the Fixed Wireless Internet Service Plan and any plans subscribed by YTLC\u2019s enterprise customers .
    \n\u201cIn Wallet<\/strong>\u201d means a digital wallet in which the Cash Reward earned by a Referrer\/ Referee during the Cash Reward Earned Period is reflected. For clarity, each Referrer and Referee will be assigned one (1) In Wallet based on his\/her NRIC or passport number registered with YTLC.
    \n\u201cCash Reward Earned Period<\/strong>\u201d means the applicable period during which a Referrer and Referee may earn the Cash Reward, subject to the pre-conditions as more particularly stated in Clause 6 herein.
    \n\u201cReferee<\/strong>\u201d refers to an individual, but excluding a Referrer, who subscribes to any of the Kasi Up Plans through MyYes app or YES Online Store by use of the Referral Code.
    \n\u201cReferral Code<\/strong>\u201d means and refers to a code in the form of numerical character replicating the Yes Mobile Number subscribed by the Referrer under any of the Service Plans.
    \n\u201cReferrer<\/strong>\u201d is a subscriber of any of the Service Plans, who refers his family and\/or friends to subscribe to the Kasi Up Plans and Jaringan Prihatin Plans by use of his\/her Referral Code.
    \n\u201cService Account<\/strong>\u201d means the service account assigned by YTLC to the Referrer and Referee for each of the Service Plan subscribed.
    \n\u201cService Plans<\/strong>\u201d means any of the Postpaid Service Plans, including the YES Postpaid FT5G Service Plans, Prepaid Service Plans, including the YES Prepaid FT5G Service Plans, and\/or Kasi Up Plans, but excluding the Excluded Service Plans.
    \n\u201cKasi Up Plans<\/strong>\u201d means those service plans as more specifically stated in Appendix 1 herein, under the heading \u201cPlans\u201d.
    \n\u201cJaringan Prihatin Plan<\/strong>\u201d means collectively the YES Prihatin Learn From Home For Individuals Service Plan, YES Prihatin Learn From Home For Families Service Plans, YES Prihatin Learn From Home Family Postpaid and YES Prihatin Learn From Home Individual Postpaid.
    \n\u201cYES Prepaid FT5G Service Plans<\/strong>\u201d means the YES Prepaid FT5G Service Plans as more specifically stated in the YES First To 5G Campaign Terms and Conditions and Appendix 1 below.
    \n\u201cYES Postpaid FT5G Service Plans<\/strong>\u201d means collectively the YES Postpaid FT5G Postpaid Service Plans as more specifically stated in the YES First To 5G Campaign Terms and Conditions and Appendix 1 below.
    \n\u201cYES Online Platform<\/strong>\u201d means MyYes app or YES Online Store.
    \n\u201cYES Offline Platform<\/strong>\u201d means YES Store or YES Dealer.<\/li>\n
  4. Programme Period.<\/strong>
    \nThe R&E Programme is a time limited programme commencing on 15th December 2020, 12:00 a.m. and will continue until further notice (\u201cProgramme Period<\/strong>\u201d).<\/li>\n
  5. Programme Mechanism.<\/strong>
    \n5.1 A Referrer may participate in the R&E Programme by sharing the Referral Code with his\/her family and friends.
    \n5.2 When a Referee successfully subscribes to:-
    \n5.2.1 any of the Kasi Up Plans by applying the Referral Code via YES Online Platform,5the Referee and Referrer may be eligible to receive Cash Reward, subject to Clause 6 herein; or
    \n5.2.2 any of the Jaringan Prihatin Plan by applying the Referral Code via YES Online Platform or YES Offline Platform, the Referrer may be eligible to receive the Cash Reward.
    \nIf a Referee keys in a referral code of an Eligible Person who is not the Referrer, such Eligible Person will be entitled to the Cash Reward.
    \n5.3 Subject to the applicable laws, including codes, directives and guidelines issued by the Malaysian Communications and Multimedia Commission, a Referee may subscribe to multiple Kasi Up Plans by use of the same Referral Code and be entitled to the Cash Reward.<\/li>\n
  6. Cash Reward.<\/strong>
    \n6.1 A Referrer may be entitled to Cash Reward:<\/p>\n

    6.1.1 if the Referee had subscribed to any of the Kasi Up Plans, Jaringan Prihatin Plan, YES Postpaid FT5G Service Plan or YES Prepaid FT5G Service Plans by applying the Referral Code; and
    \n6.1.2 both the Referrer\u2019s and Referee\u2019s Service Account remains active during the Cash Reward Earned Period.
    \n6.2 A Referee may be entitled to Cash Reward in relation to subscription of any Kasi Up Plans, YES Postpaid 5G Service Plans or YES Prepaid 5G Service Plans if the Referee\u2019s Service Account remains active during the Cash Reward Earned Period.
    \n6.3 For clarity, the word \u201cactive\u201d as referred to in Clauses 6.1.2 and 6.2 means the Referrer\u2019s and Referee\u2019s Service Account is not barred or suspended during the Cash Reward Earned Period.
    \n6.4 For further details on Cash Reward and Cash Reward Earned Period, please refer to Appendix 1 herein.
    \n6.5 A Referrer\/ Referee may redeem the Cash Reward in his\/her In Wallet via the following methods:
    \n6.5.1 Payment of Bill(s), as more specifically described in Clause 7 herein;
    \n6.5.2 Purchase of Prepaid Reload, as more specifically described in Clause 8 herein;
    \n6.5.3 Purchase of Data Add-On, as more specifically described in Clause 9 herein; or
    \n6.5.4 Cash out, as more specifically described in Clause 10 herein.<\/li>\n

  7. Payment of Bill.<\/strong>
    \n7.1 Subject to Clause 7.3 herein, a Referrer\/Referee may use Cash Reward in his\/her In Wallet to off-set against any payment of Bill provided always that the Service Account is not terminated during such payment.<\/p>\n

    7.2 If a Referrer\/Referee has overpaid his\/her Bill by using the Cash Reward, then any amount that is overpaid will be used to set off against the Referrer\u2019s\/Referee\u2019s future Bill(s) under the same Service Account, and will not be redeposited into his\/her In Wallet. For clarity in the event of termination of the Service Account and where there is any amount overpaid, such overpayment, less any deduction for outstanding sums payable to YTLC, will be refunded to the Referrer\/ Referee.
    \n7.3 Cash Reward cannot be used towards payment of Bill by way of Auto Billing.<\/li>\n

  8. Purchase Prepaid Reload by use of Cash Reward.<\/strong>
    \n8.1 Subject to Clause 8.2 herein, a Referrer\/ Referee of a Prepaid Service Plan, including the YES Prepaid FT5G Service Plan may use Cash Reward in the In Wallet to purchase any of the available Prepaid Reload denominations provided always that the Service Account is not barred or suspended, unless such barring or suspension is due to insufficient credit in the Prepaid Account. In such instance, the Referrer and\/or Referee may use Cash Reward in the In Wallet to purchase any of the available Prepaid Reload denominations.
    \n8.2 A Referrer\/ Referee shall ensure that he\/she has sufficient Cash Reward in his\/her In Wallet prior to purchase of any available Prepaid Reload. For clarity, a Referrer\/ Referee is not allowed to purchase any Prepaid Reload denomination of a higher value than the Cash Reward available in his\/her In Wallet.<\/li>\n
  9. Redemption of Cash Reward for the Purchase Data Add-On.<\/strong>
    \n9.1 Subject to Clause 9.2 herein, a Referrer\/ Referee may use the Cash Reward to purchase any available Data Add-On, except for data add-on for International Roaming Service, provided always that purchase of such Data Add-On is successfully performed at any time prior to termination of the related Service Account.
    \n9.2 A Referrer\/ Referee shall ensure that he\/she has sufficient Cash Reward in his\/her In Wallet prior to purchase of any available Data Add-On. For clarity, a Referrer\/ Referee is not allowed to purchase any Data Add-On denomination which is of a higher rate than the Cash Reward available in his\/her In Wallet.<\/li>\n
  10. Redemption of Kasi Up Cash Reward by way of cash out.<\/strong>
    \n10.1 A Referrer\/ Referee may redeem Cash Reward credited in his\/her In Wallet by way of cash out via     MyYes<\/a> app\u00a0subject to the following terms and conditions:
    \n(a) the Referee\u2019s\/ Referee\u2019s Service Account remains active during such redemption; and
    \n(b) subject to Clause 6 herein, the Referrer\/ Referee submits such request via     MyYes<\/a> app by completing all the relevant information in the required fields. For clarity, a Referrer\/ Referee is allowed to perform one (1) cash out redemption only per day for a minimum sum of Ringgit Malaysia Fifty (RM 50.00) only and a maximum sum of Ringgit Malaysia Five Thousand (RM 5,000.00) only, provided that the total redemption of Cash Reward in a calendar month does not exceed the sum of Ringgit Malaysia Twenty Thousand (RM 20,000.00) only.
    \n10.2 A Referrer\/ Referee is not allowed to amend or withdraw any application for cash out of the Cash Reward once such application is successfully submitted to YTLC.
    \n10.3 A Referrer\/ Referee may provide his\/her bank account or of any third party of his\/her choice provided always that the bank account is with any of the banks in Malaysia for redemption of Cash Reward by way of cash out. If the Referrer\/ Referee decides to redeem the Cash Reward through a third party\u2019s bank account, YTLC and\/or its affiliates shall not be held responsible on any issue arising between the Referrer\/ Referee with such third party as a result thereof. Further, the Referrer and Referee shall and hereby agree to indemnify and keep YTLC and its affiliates indemnified against any such claim, loss and\/or expense suffered by YTLC as a result thereof.
    \n10.4 Upon successful submission of a request for redemption of Cash Reward by way of cash out in accordance with this Clause 10, YTLC will send a Transactional Authorization Code or commonly known as TAC via SMS to such Referrer\u2019s\/ Referee\u2019s registered Yes Mobile Number associated with the related Service Account and\/or registered e-mail address. In order to successfully complete the transaction to transfer the cash from the In Wallet, the Referrer\/ Referee is required to fill in the TAC in the designated field.
    \n10.5 The Referrer and Referee hereby agrees that the redemption of Cash Reward by way of cash transfer is also subjected to guidelines imposed by Bank Negara Malaysia and all other applicable terms and conditions of the respective participating financial institutions in Malaysia. You are responsible to read the terms and conditions of the respective financial institutions.
    \n10.6 Referrer\/ Referee is entitled to redeem Cash Reward at any time prior to termination date of the Service by way of     MyYes<\/a> app. Any unredeemed Cash Reward in the In Wallet will be surrendered to the Registrar of Unclaimed Money under the Accountant-General\u2019s Department.<\/li>\n
  11. Limitation of Liability.<\/strong>
    \nYTLC and\/or its affiliates shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the R&E Programme.<\/li>\n
  12. Laws.<\/strong>
    \nThe R&E Programme shall in all respects be governed by the laws of Malaysia.<\/li>\n
  13. Modifications.<\/strong>
    \nYTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the R&E Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Persons or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend the R&E Programme at any time before or during the Programme Period with notice but without any liability or compensation whatsoever.<\/p>\n
