  1. The Promotion<\/strong>. The Pakej YES Peranti Keluarga Malaysia Promotion (\u201cPromotion<\/strong>\u201d) is an initiative by the Government of Malaysia in collaboration with YTL Communications Sdn Bhd (Company No.200701035605 (793634-V)) (\u201cYTLC<\/strong>\u201d) and other telecommunications operators.<\/li>\n
  2. Eligibility<\/strong>. This Promotion is open to all Malaysians with a valid MyKad or MyPR or MyTentera, as applicable (\u201cEligible Subscribers<\/strong>\u201d).<\/li>\n
  3. Applicable Terms & Conditions<\/strong>. Subject only to the variations as expressly set out in this Pakej YES Peranti Keluarga Malaysia Promotion Terms and Conditions (\u201cPromotion T&Cs<\/strong>\u201d), all other terms and conditions incorporated in the Postpaid Service Terms and Conditions and Postpaid Service Plans Terms and Conditions (collectively referred as \u201cGeneral Applicable Terms and Conditions<\/strong>\u201d), available at\u00a0yes.my\/tnc <\/a>shall remain valid and applicable to this Promotion. In the event of any inconsistency between the General Applicable Terms and Conditions and these Promotion T&Cs, these Promotion T&Cs shall prevail to the extent of any such inconsistency. Capitalised words not defined herein shall have the same meaning ascribed to them in the General Applicable Terms and Conditions.<\/li>\n
  4. Promotion Period<\/strong>. The Promotion commences on 8th<\/sup> April 2022, 12:00 a.m. until 31st<\/sup> October 2022, 12:00 p.m. (\u201cPromotion Period<\/strong>\u201d).<\/li>\n
  5. The Promotion<\/strong>.
    \n5.1 Subject to Clause 5.3 herein, during the Promotion Period, an Eligible Subscriber may subscribe to the following promotion package:-

    \n(hereinafter shall be collectively referred to as the \u201cPromotion Package<\/strong>\u201d).<\/p>\n

    \n**Additional 1GB Daily LTE Data from the date of SIM activation during contract period. Eligible Subscriber may redeem it ONCE a day manually via MyYes<\/a> app<\/span>.
    \n<\/span>*** To receive the rebate, the Eligible Subscriber\u2019s Service account must be active. Where the Eligible Subscriber\u2019s Service account is suspended, terminated or barred, he\/she will not be entitled to receive the rebate.<\/p>\n

    5.3 Each Eligible Subscriber is entitled to subscribe to a maximum of two (2) Pakej YES Peranti Keluarga Malaysia, <\/strong>Peranti Keluarga Malaysia Samsung A02 Promo, Peranti Keluarga Malaysia Alcatel L7 Promo and Peranti Keluarga Malaysia Altitude 4 Promo <\/strong>respectively provided that he\/she:-
    \n(a) does not have, in aggregate, more than six (6) postpaid Service accounts with YES; and
    \n(b) does not have any outstanding payments with YES.
    \n(a) does not have, in aggregate, more than six (6) postpaid Service accounts with YES; and
    \n(b) does not have any outstanding payments with YES.<\/p>\n

    5.4 An Eligible Subscriber may subscribe to the Promotion Package through the following channels:
    \n(a) Pakej YES Peranti Keluarga Malaysia via\u00a0    MyYes<\/a>\u00a0app or\u00a0YES Online Store<\/a>\u00a0; and
    \n(b) Peranti Keluarga Malaysia Samsung A02 Promo, Peranti Keluarga Malaysia Alcatel L7 Promo and Peranti Keluarga Malaysia Altitude 4 <\/strong>via YES Stores only.<\/p>\n

    5.5 In the event an Eligible Subscriber has fully utilised the Data Capacity Allocation before the end of the relevant Billing Cycle, the Eligible Subscriber may still use the internet data service but at a reduced internet data speed of 256kbps provided that his\/her Service account is active or purchase a Postpaid Data Add-On to enjoy internet data with no speed control. For clarity, any mention on speed shall mean the optimum speed which means the actual speed enjoyed by an Eligible Subscriber may vary depending on various other factors including but not limited to technical and environmental factors.<\/p>\n

    5.6 Upon delivery of the SIM Card to the Eligible Subscriber, the Eligible Subscriber is required to perform a one-time activation of the SIM Card within seven (7) upon receiving the SIM Card, failing which the SIM Card will be automatically activated at the expiry of the period of seven (7) days mentioned hereinbefore.<\/p>\n

    5.7 If a Eligible Subscriber terminates his\/her Service account under this Promotion or ports out to another service provider before the expiry of the Contract Period or if the Service account is terminated by YES as a result of the Eligible Subscriber\u2019s breach of the General Applicable Terms and Conditions and\/or these Promotion T&Cs, the Early Termination Charges as more particularly stated in the Postpaid Service Terms and Conditions shall apply accordingly. The Early Termination Charges is payable in addition to all other monies owing by the defaulting Eligible Subscriber to YES up to the time of early termination and any other remedies available to YES.
    \n5.8 An Eligible Subscriber is not allowed to upgrade or downgrade the Promotion Package he\/she has subscribed to during the Contract Period.<\/li>\n

  6. Charges & SST<\/strong>
    \n6.1 Save as expressly provided herein (including Clause 5.2 above), there will be no additional charges imposed for domestic On-Net Services (voice calls and SMS) and domestic Off-Net voice calls. However, the following charges will be imposed for domestic Off-Net SMS:-<\/p>\n\n\n\n\n

    6.4 The charges stated in this Clause 6 is exclusive of SST.<\/li>\n

  7. Warranty.<\/strong> The Device provided under the Promotion Package is subject to the Device manufacturer\u2019s standard warranty.<\/li>\n
  8. Exclusion of liability for use of the Device<\/strong>. YTLC shall not be liable to an Eligible Subscriber or any person(s) claiming through the Eligible Subscriber for any loss, damages or injury arising from the use or inability to use the Device from any cause whatsoever.<\/li>\n
  9. Limitation of Liability.<\/strong> YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion.<\/li>\n
  10. Laws.<\/strong> This Promotion shall in all respect be governed by the laws of Malaysia.<\/li>\n
  11. Modifications. <\/strong>YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Promotion, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party.
