  1. The Programme.<\/strong>
    \nThe Yes FT5G Discover SIM Pack Programme (\u201cProgramme\u201d<\/strong>) is a time-limited programme launched by YTL Communications Sdn Bhd (Company No.200701035605 (793634-V)) (\u201cYTLC\u201d<\/strong>).<\/span><\/li>\n
  2. Eligibility.<\/strong>
    \nThe Programme is open to all Malaysians and non-Malaysians residing in Malaysia aged 12 years and above with 5G smartphone (\u201cEligible Subscribers<\/strong>\u201d). (Please visit https:\/\/site.yes.my\/supported-devices<\/a> to determine which of the smartphones can support the 5G-enabled SIM Card.)<\/span><\/li>\n
  3. Applicable Terms & Conditions:<\/strong>
    \nSubject only to the variations as expressly set out herein (\u201cProgramme T&Cs<\/strong>\u201d), all other terms and conditions incorporated in the Prepaid Service Terms and Conditions, Yes 4G LTE Prepaid Plan Terms and Conditions, Prepaid Kasi Up LTE SIM Plan Terms and Conditions, Prepaid Data Add-On Terms and Conditions, Kasi Up Unlimited and Kasi Up Turbo 5GB Prepaid LTE Data Add-On Promotion Terms and Conditions and Yes First To 5G Campaign Terms and Conditions available at     www.yes.my\/tnc<\/a>\u00a0(collectively referred as \u201cGeneral Applicable Terms and Conditions<\/strong>\u201d) shall remain valid and applicable to this Programme. In the event of any inconsistency between the General Applicable Terms and Conditions and these Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to in the General Applicable Terms and Conditions.<\/span><\/li>\n
  4. Programme Period.<\/strong>
    \nThis Programme will commence on\u00a010th January 2022<\/strong>, 12:00 a.m. and continue until further notice (\u201cProgramme Period<\/strong>\u201d).<\/span><\/li>\n
  5. Application for Yes FT5G Discover SIM Pack.<\/strong>
    \n5.1 Application for the Yes FT5G Discover SIM Pack may be made via any of the following channels only namely:-
    \n(a)\u00a0    MyYes<\/a>\u00a0app; and
    \n(b)\u00a0    www.yes.my<\/a><\/span><\/p>\n

    5.2 Upon receipt of an application, YTLC will verify if the eligibility criteria in Clause 2 has been met and thereafter an email notification will be sent to inform the applicant if his\/her application is successful or otherwise. If the application is successful, the Yes FT5G Discover SIM Pack will be delivered to the successful applicant at the address provided in the application form.<\/p>\n

    5.3 Each Yes FT5G Discover SIM Pack consists of one (1) 5G-enabled SIM Card and a Yes Mobile Number.<\/li>\n

  6. The Programme.<\/strong>
    \n6.1 The Service offering under the Yes FT5G Discover SIM Pack are as stated below:-<\/span><\/p>\n\n\n\n\n\n\n\n\n\n\n\n\n

    Special Offer<\/th>\nUnlimited FT5G Data until 30th<\/sup> September 2022<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

    6.2 There will be no charges for the Yes FT5G Discover SIM Pack during the Programme Period.<\/p>\n

    6.3 Each Eligible Subscriber is entitled to register one (1) Yes FT5G Discover SIM Pack only provided that the Eligible Subscriber does not have, in aggregate, more than five (5) prepaid service accounts with Yes.<\/p>\n

    6.4 Upon receipt of the SIM Card, the Eligible Subscriber is required to perform a one-time activation of the SIM Card within a period of thirty (30) days from the date of receipt of the SIM Card, failing which the SIM Card can no longer be activated and no replacement SIM Card will be provided.<\/p>\n

    6.5 A Subscriber of the Yes FT5G Discover SIM Pack may enjoy the service offerings under the 5G network until further notice; thereafter, the service offerings will be on a 4G network. Such Subscriber may also purchase the FT5G Data Add-On as specified in Clause 6 of the Yes First To 5G Campaign Terms and Conditions or the Kasi Up Turbo 5GB Prepaid LTE Data Add-On as specified in the Kasi Up Unlimited and Kasi Up Turbo 5GB Prepaid LTE Data Add-On Promotion Terms and Conditions.<\/p>\n

    6.6 Please take note that certain areas may not be within 5G network coverage. In such instance, a Subscriber of the Yes FT5G Discover SIM Pack will continue to enjoy uninterrupted 4G connectivity on our Yes network.<\/p>\n

    6.7 The 5G internet speed on the Yes FT5G Discover SIM Pack fully depends on the 5G network coverage in such area.<\/p>\n

    6.8 The 5G-enabled SIM Card can only be used on certain types of smartphones. As such, please visit https:\/\/site.yes.my\/supported-devices<\/a> to determine which of the smartphones can support the 5G-enabled SIM Card.<\/p>\n

    6.9 The unlimited On-Net Services are exclusive for Your use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using Your SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.<\/p>\n

    6.10 Charges & SST<\/p>\n

    6.10.1 Save as expressly provided herein, there will be no charges imposed on Eligible Subscriber use of domestic On-Net Services. However, the following charges will be imposed on Eligible Subscriber\u2019s use of domestic Off-Net Services:-<\/p>\n\n\n\n\n\n

  7. Limitation of Liability.<\/strong>
    \nYTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme.<\/span><\/li>\n
  8. Laws.<\/strong>
    \nThis Programme shall in all respect be governed by the laws of Malaysia.<\/span><\/li>\n
  9. Modifications.<\/strong>
    \nYTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party.
